Follow-up to Sons of Gwalia

I always have a difficult time parsing the language and reasoning of Australian legal scholarship and decisions. American legal writings are also often clear as mud, but somehow less arcane. Anyway, the result reached by the appellate Federal Court of Australia, by whatever strain of legal reasoning, in the Sons of Gwalia case is no different than I had gotten to in my post last year, A question of priorities.
